New Mexico uses a “front-loaded” fee structure. While the initial pages are relatively expensive, the per-page rate for large records is among the lowest in the Western United States.

The “Actual Cost” Rule for Electronic Records

Under 16.10.17.8(B) NMAC, if a patient or representative requests records in an electronic format, the physician or facility may only charge the actual cost of reproduction.

2. Prohibition on Withholding Records

A critical protection in New Mexico law (16.10.17.8(A) NMAC) is that medical records may not be withheld because a patient has an overdue account or owes a bill for treatment or previous services. Access to the information is a right that exists independent of the patient’s financial balance with the provider.

3. Psychotherapy Notes

New Mexico follows federal standards regarding psychotherapy notes. Under 16.10.17.8(C) NMAC, these notes must be maintained separately from the primary medical record. A patient does not have a right to read or copy these specific notes, and their release to other providers requires express patient authorization.

While state law allows for a $30.00 initial charge, federal HIPAA regulations act as a “ceiling” for patients requesting their own records:
