Missouri Medical Record Fees: The 2025-2026 Statutory Guide

In Missouri, medical record fees are regulated under RSMo 191.227. The law requires that providers furnish records within a “reasonable time” and sets maximum fee caps that are adjusted annually every February 1st based on the Consumer Price Index (CPI) for medical care.

The “$133.30 Electronic Ceiling”

Under RSMo 191.227.2(1)(b), if a provider maintains records in an electronic format and the requester asks for digital delivery, the total charge cannot exceed $133.30.

2. Off-Site Storage Fees

If a healthcare provider contracts with an outside storage facility for records management, they may charge an additional $28.47 labor fee for retrieval. This only applies if the records are physically stored off-site and are not accessible via the provider’s local electronic system.

3. Notary and Certification Fees

If a requester asks for an affidavit or a “Certification of Medical Records,” the provider may charge a notary fee not to exceed $2.00.

4. The Patient Rate (HIPAA Protection)

While Missouri state law allows for a $30.41 handling fee, federal HIPAA law provides a protective floor for patients.

  2. Search vs. Handling: Providers cannot charge both a “Search Fee” and a “Handling Fee.” Missouri law groups these into a single administrative charge.
