Illinois Medical Record Fees: The 2025-2026 Statutory Guide
In Illinois, the amount a provider can charge for medical records depends entirely on who is making the request. As of early 2026, Illinois law (735 ILCS 5/8-2001) provides some of the strongest patient protections in the country, including a mandate for free records in specific legal and clinical scenarios.
1. Statutory Fee Schedule (2026 Adjusted Rates)
The Illinois Office of the Comptroller adjusts these fees annually based on the Consumer Price Index (CPI). For 2026, the law maintains a strict “50% discount” for records delivered in an electronic format.

The “50% Digital Rule”
Under 735 ILCS 5/8-2001(d), if records are retrieved from a digital format (EMR/EHR), the per-page charge cannot exceed 50% of the paper rate. This fee includes the cost of the media itself (CD, DVD, or USB flash drive). If a provider has an electronic system, they must provide the records in electronic format if you request it.
2. The “One Free Copy” Rule
Perhaps the most important provision in Illinois law is 735 ILCS 5/8-2001(h). Healthcare facilities and practitioners must provide one complete copy of a patient’s records free of charge if the request is for:
- Supporting a claim for Federal Social Security or Supplemental Security Income (SSI) benefits.
- Supporting a claim for Federal Veterans’ Disability benefits.
- Supporting a claim for Aid to the Aged, Blind, or Disabled (AABD).
Note: This free copy is available to the patient or their attorney/representative, provided they submit a valid authorization and documentation of the qualifying claim.
3. The Patient Rate (HIPAA Protection)
Under federal HIPAA regulations, if a patient requests their own records directly for personal use, the provider is limited to a “reasonable, cost-based fee.”
- Electronic Records: Often provided as a flat fee (approximately $6.50).
- No Handling Fees: Under HIPAA, providers cannot charge “Handling” or “Search” fees to patients, even though the Illinois statute allows a $36.68 handling charge for third-party requests.
