Idaho Medical Record Fees: 2026 Statutory Guide
As of July 1, 2025, Idaho law has been updated via SB 1087 to provide specific protections for patients seeking disability benefits. For all other types of requests, Idaho follows the federal HIPAA “reasonable cost-based fee” standard.
1. Statutory Fee Schedule (2026)
Because the broader fee-cap bill (SB 1395) failed to pass, Idaho does not have a state-mandated “per-page” price list for standard requests. Providers must follow federal HIPAA guidelines (45 CFR § 164.524).

2. Mandatory Free Records (Social Security)
Under the newly enacted Idaho SB 1087, healthcare providers must provide one (1) free copy of a patient’s medical records per year if the request is to support a claim or appeal for Social Security benefits (SSDI/SSI).
- This applies to requests from the patient, their attorney, or an authorized representative.
- Records must be provided within 30 days.
- Exemption: Small, independently owned providers with fewer than 50 employees who do not use a third-party copy service are exempt from the “free copy” requirement.
3. Standard Request Protections (HIPAA)
For all other requests (Personal Injury, General Interest, etc.), Idaho falls back on federal law. This means:
- No Search Fees: Providers cannot charge for the labor of “finding” the record.
- Actual Costs Only: Charges are limited to the cost of paper, toner, and the labor spent specifically on duplication.

- The Social Security “Freebie”: If you are working on an Idaho disability case, do not pay an invoice for the first set of records. Cite SB 1087 (Effective 2025) to have the invoice zeroed out.
- Third-Party Vendors: Vendors like Ciox or Sharecare often try to apply “standard” search fees ($20+) in Idaho. Since Idaho has no state law authorizing these, they are a violation of the federal HIPAA access right.
- The 30-Day Clock: Idaho law now mirrors the 30-day HIPAA deadline, but with the added weight of state-level oversight under the new health code.
